This Privacy Policy describes how the Colorado Department of Public Health and Environment - Emergency Preparedness and Response Division (“EPRD,” “we,” “us,” and “our”) protects your privacy when you use the web site located at www.WhatIfColorado.com (the “Site”) or when you otherwise enter the What If? Colorado Reality Competition (the “Competition”) or provide personal information in connection with the Competition.

2. Your Consent to This Privacy Policy

We reserve the right to update or modify this Privacy Policy, at any time and without prior notice, by posting the revised version of this Privacy Policy on the Site.  Your use of our Site or other provision of personal information to us following any such change constitutes your agreement that all personal information collected from or about you after the revised Privacy Policy is posted will be subject to the terms of the revised Privacy Policy.  You may access the current version of this Privacy Policy at any time by clicking on the link marked "Privacy Policy" at the bottom of each page of our Site. 

4. What Personal Information Do We Collect?
Information You Volunteer.  We collect the personal information you knowingly and voluntarily provide when you use our Site, for example, the information you provide when you enter the Competition through our Site or through other means, or if you otherwise provide us with personal information in connection with the Competition or Competition activities (including the activities on our Site). 

Information Sent to Us by Your Web Browser.  We may collect information that is sent to us automatically by your web browser, such as your IP address, the address of the web page you were visiting when you accessed our Site, information on your operating system and browser, and the date and time of your visit.  The information we receive depends on the settings on your web browser. 

The information provided by your browser does not identify you personally.  We use this non-personal information primarily to create statistics that help us improve our Site.     In addition, we may review our server logs for security purposes, such as detecting intrusions into our network.  If we suspect criminal activity, we might share our server logs -- which contain visitors’ IP addresses -- with the appropriate investigative authorities who could use that information to trace and identify individuals.

Information Collected Using “Cookies” and Other Web Technologies.  Like many commercial sites, we may use "cookies," and similar technologies to collect information and manage our Site.  A cookie is a small text file that is placed on your hard disk by a Web server.  Cookies cannot be used to install computer programs or deliver viruses to your computer.  We may use cookies to collect information about the ways visitors use our Site or to facilitate your interactions with our Site.  We may also use cookies to offer you a personalized experience when you use our Site, or to help us keep a more accurate account of how many people visit our Site, how often they return, how their use of our Site may vary over time, and the effectiveness of our promotional efforts.   Cookies do not identify you personally.

5. How Do We Use or Share Your Personal Information?
Competition Entries.  If you have entered the Competition on our Site or otherwise, we may use or share with third parties certain data you submit in connection therewith (including without limitation your first and last name, biography, likeness, voice, photographs, video, opinions, hometown, state and country) for use in any manner or media in connection with the Competition, the promotion thereof, news reporting thereon, or otherwise, including commercial exploitation.  However, we will not share your full mailing address or telephone number with third parties other than those providing services to us related to the Competition.  

Other Personal Information. 

We may use personal information collected through our Site or otherwise to allow you to interact with the features on the Site or otherwise as applicable to send you any information you may request, , and for any other purpose we may disclose to you from time to time.

We will not share your personal information with third parties for their direct marketing purposes.  We may share personal information collected through our Site or otherwise with companies and organizations that perform services on our behalf, for example, companies that manage the administrative aspects of the Competition (such as voting), or provide support services to us (such as data storage and web hosting services).  We may disclose the personal information we collect through our Site or otherwise when we, in good faith, believe disclosure is appropriate to comply with the law (or a court order or subpoena); to prevent or investigate a possible crime, such as fraud or identity theft; to enforce the terms of use or other agreements that govern your use of our Site; to protect the rights, property or safety of EPRD, our users or others; or to protect your vital interests. Information submitted to EPRD is an asset of EPRD and will become part of our normal business records.  Your personal information may be transferred to a successor in interest of EPRD.  If such a transfer occurs, the acquiring company’s use of your personal information will still be subject to this Privacy Policy, and the privacy preferences you have expressed to us. 

6. Modifying Your Information
We respect your right to make choices about the ways we collect, use and disclose your personal information.  You may update or modify your personal information previously collected by EPRD sending an e-mail to info@whatifcolorado.com.    However, if we receive a request from you or any third party to delete any information submitted by you in connection with the Competition (including without limitation your biography or video), we reserve the right to immediately disqualify you from the Competition in our sole discretion. 

7. Security
We use encryption and other technologies that maintain the security of your connection when you register on our Site.  However, "perfect security" does not exist on the Internet and we can not guarantee the safety of transmitting personal information over the Internet. 

8. Privacy on Third-Party Sites
Our Site contains links to third party sites that are not operated by EPRD.  EPRD does not control these sites and is not responsible for their data practices.  We urge you to review the privacy policy posted on any third party site you visit before using the site or providing any personal information about yourself on that site.
